1. Service Description
CharityFile provides charitable solicitation compliance tracking software for nonprofit organizations. Our service helps you track registration deadlines, calculate fees, and manage your compliance obligations across multiple states.
2. Not Legal Advice
CharityFile is not a law firm and does not provide legal advice. The information provided through our service is for general informational purposes only. While we strive to keep our compliance database accurate and up-to-date, state requirements change frequently, and you should verify all information with the appropriate state agency before relying on it.
You should consult with a qualified attorney licensed in the relevant jurisdiction for advice specific to your organization's situation. We recommend seeking legal counsel for complex compliance questions.
3. User Responsibilities
You are responsible for:
- The accuracy of all information you provide to us, including your EIN, revenue figures, and state registrations
- Submitting all required filings to state agencies yourself - CharityFile does not file on your behalf
- Verifying deadlines, fees, and requirements with official state sources before filing
- Maintaining appropriate records of your filings and compliance activities
- Keeping your account information and password secure
4. No Guarantee of State Acceptance
CharityFile does not guarantee that any state will accept your registration, renewal, or other filings. State agencies make independent determinations about compliance based on their own rules and review processes. We provide tools to help you prepare and track your filings, but the ultimate decision rests with each state agency.
We are not responsible for any penalties, fines, or other consequences that may result from late filings, rejected applications, or other compliance failures.
5. Subscription and Billing
CharityFile is a subscription service billed on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the applicable subscription fees.
Subscriptions automatically renew unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation, you will retain access until the end of your current billing period.
6. Refund Policy
We offer a 14-day refund policy for new subscriptions. If you are not satisfied with CharityFile within the first 14 days of your initial subscription, contact us at support@charityfile.com to request a full refund.
After the initial 14-day period, we do not provide refunds for subscription fees already charged. Refunds are not available for renewal periods, partial months, or unused portions of your subscription.
7. Limitation of Liability
To the maximum extent permitted by law, CharityFile and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, arising out of or related to your use of the service.
Our total liability for any claims arising from your use of the service shall not exceed the amount you paid to us in subscription fees during the twelve months preceding the claim.
8. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes by posting the new terms on our website and updating the "Last updated" date. Your continued use of the service after changes become effective constitutes acceptance of the new terms.
